Do union lawyers have any control over their pickets?

RESIDENTS HAVE BEEN INFORMED that the United Steel Workers attorneys, Henry Huerta and other organizers from the CLEAN Car Wash Campaign UNDERSTAND residents  concerns and complaints about the loud noises coming from the picket line.  All residents even received a letter (in March)  from Henry Huerta  apologizing for the noise.

After 7 miserable  months,  it is overwhelmingly clear the pickets are  engaged in their ‘disturbing the peace’ activity for the purpose of  annoying  the neighbors, car wash customers, workers and owner.  Their yelling is disruptive and not communicative in nature.  Their loud noise conduct IS intentional to create  a disturbance and their ‘free speech communication’ is  used as a guise to that end.  The LAPD has informed pickets, union lawyers and organizers to stop making loud, unreasonable noise, and YET,  AS OF May 30, 2010, THE PICKET NOISE CONTINUES!  Is this conduct not both willful and malicious?

Residents want to know:  HOW LONG DOES IT TAKE  for union lawyers to tell pickets to stop their yelling?

It is  long over-due for the union to cut the games and release residents from being held hostage to their noisy effort to unionize (or kill) the Robertson Car Wash.  We demand to be free from this loud and angry skirmish.

Pickets Yelling in Front of LAPD Labor Relations Unit

Residents have witnessed picketers YELLING right in front LAPD Labor Relations sergeants. Sadly, today, May 21st, was no different. LAPD has been told by City Attorney’s office to not enforce our LAMC Noise Law 116.01.

High courts HAVE ruled that the government may regulate a marcher’s use of the streets based on legitimate interests, such as: protecting those who are not interested onlookers, like a “captive audience” in a residential neighborhood, from the adverse collateral effects of the speech. As the U.S. Court of Appeals for the District of Columbia stated in Christian Knights of KKK v. District of Columbia that when using a public forum, “…speakers do not have a constitutional right to convey their message whenever, wherever and however they please.” Source http://www.lectlaw.com/files/con10.htm

DESPITE PROMISES TO STOP THE YELLING,  CLEAN CAR WASH CAMPAIGN PICKETS CONTINUE MAKING THEIR NASTY NOISE (UNDER THE GUISE OF free speech),  THEY WRECK THE PEACE AND TRANQUILITY OF ALL RESIDENTS,  THEY DISRESPECT THE RESIDENTIAL NEIGHBORHOOD, THEY FORCE THEIR NOISE ON US AGAINST OUR CIVIL RIGHT TO NOT HEAR IT, AGAINST OUR CIVIL RIGHT TO HAVE PEACE IN OUR OWN HOMES, THIS GROUP OF PICKETS ARE INVADING OUR PRIVACY.

CITY OF LOS ANGELES, PLEASE!  MAKE THEM STOP THE NOISE!   THEY AREN’T DOING IT VOLUNTARILY!!!

May 19, 2010 — This video was taken at 4:11 p.m.  – CLEAN Car Wash Campaign noise-making pickets disturbing the peace in a residential neighborhood. 7 months of this – and they just won’t stop no matter how much it annoys the residents. Thanks USW.

May 19, 2010 — Video taken at 4:10 pm – yelling heard inside house..looking out window… WTF? It’s the CLEAN Car Wash pickets from Los Angeles part of United Steel workers. Trying to force a private small business to join their union which is not working, and they continue to bother every resident in the area, and the residents now hate unions and their bullying tactics and they support the car wash.  None of these pickets have ever worked at the car wash.  None of them even live in the neighborhood.   They’re a group of loud, nasty people who actually  enjoy making noise, bothering the residents, customers and the car wash employees.

In a 1988 Supreme Court Decision on residential picketing (Frisby v. Schultz) Justice Sandra Day O’Connor wrote for the majority because of the importance of ”protection of residential privacy” against ”the devastating effect of targeted picketing on the quiet enjoyment of the home.” Stressing that ”even a solitary picket can invade residential privacy,” she said, ”There simply is no right to force speech into the home of an unwilling listener.”

Even the dissenting opinions of Justice William J. Brennan Jr., Justice Thurgood Marshall and John Paul Stevens said some types of residential picketing could properly be banned, such as unduly loud chanting. Attorney Benna Ruth Solomon said, ”We are pleased that the Court recognizes the importance of privacy and tranquility in the home and that people have rights to be free from intrusive, distressing picketing in that last sanctuary.”

CITY OF LOS ANGELES:  THE INTENT OF THE ABOVE IS: WE HAVE RIGHTS UNDER THE SUPREME COURT TO ENJOY QUIET IN OUR HOMES; NO RIGHT TO FORCE FREE SPEECH INTO THE HOME OF AN UNWILLING LISTENER; IT’S OKAY TO BAN LOUD CHANTING, THE CLEAN CAR WASH CAMPAIGN PICKETS  ARE INTRUSIVE AND DISTRESSING.   ONCE AGAIN,  CITY OF LOS ANGELES, PLEASE MAKE THEM STOP THE NOISE.   THEY AREN’T DOING IT VOLUNTARILY!!!

PICKETS GROWL WHISTLE YELL

We’ve got 6 videos taken Saturday, May 15, 2010 which prove just how loud, annoying, and disruptive the pickets are. One video is 25 minutes long. Here is a 2-1/2 minute video so you can hear the pickets growl, whistle and yell. What does THIS have to do with “peaceful picketing and free speech”?

The yellow duplex (across the street, on the left) is now FOR SALE. Several of us believe that because of union NOISE, it has become unfit for anyone to inhabit. HEY, CLEAN CAR WASH CAMPAIGN: SHAME ON YOU!!!!!!!

6 hours of picket yelling

Saturday, May 15, 2010 – – Clean Car Wash Campaign pickets were at the Robertson Car Wash for 6 hours.  We have many videos  (most from over 200 feet away)  proving how their loud chanting, yelling and growling carries far beyond their ‘supposedly’  intended target (the car wash)  and disturbs the peace of the neighborhood.  We have one video that runs 25 minutes continuously, proving how  long their disruptions are. Listen to this sample of May 15th “peaceful picketing” which the LAPD has been protecting for 7 months. BE SURE TO LISTEN TO THE WHOLE AUDIO CLIP.  IT STARTS OUT SOFTLY AND THEN SHOWS HOW PICKET VOICES GET *MUCH* LOUDER…. Seven months of this noise for hours at a time is just tooooo much to tolerate!

What is free speech?

“Freedom of speech” gives us the right to say WHATEVER we want.

It doesn’t give us the right to say it AS LOUD AS WE WANT.

The right to freedom of speech may be limited when conflicting with other rights… SUCH AS MY RIGHT TO PEACE AND QUIET IN THE CONFINES OF MY OWN HOME.

You don’t need to be a brain surgeon to figure out what NOISE IS and who is breaking the noise laws in MY NEIGHBORHOOD.   The union pickets are overstepping their bounds by coming into our neighborhood and YELLING at the top of their lungs going on 7 months now.

Los Angeles Police, City Attorney, City Council, Police Commissioners have ALL ignored our pleas to get picketers to LOWER their voices so as to not disturb the peace!     Our government officials are giving union pickets PREFERENTIAL treatment over the health, safety and welfare of homeowners and residents.  Our government officials have refused to enforce our laws against noise and have literally given union pickets an exemption from our noise laws .

Homeowners and residents “rights to peace” have been violated by union pickets AND by our government officials.  We are seeking a happy compromise.  We are not against what they are saying, we are against ‘how loud’ they are saying it.   We are against being forced to hear their angry shouts INSIDE our OWN homes with our doors and windows closed for the past 7 months!   HEY, CITY GOVERNMENT OFFICIALS,,,,, WE PAY YOUR SALARIES.   DO YOUR JOB AND ENFORCE OUR NOISE LAWS!!!!!!!!!!!!!!!!!!!!!!!!!!!

YELLING “Boy_cott ” in a residential neighborhood

We’re sick of hearing YELLING in our residential neighborhood.This picketer is OVER 300 feet away from this residential courtyard.  His voice exceeds the range allowed for amplified sound! This ain’t freedom of speech, it’s outlandish disturbing the peace. We hear this on Sunday morning and Saturday morning and Thursday and Friday for 7 g*damned months and the WLA police won’t make them lower their voices!!!!!

Entering the 7th month of ANNOYING NOISE from union pickets

SUNDAY – MAY 2, 2010 – – It’s a beautiful morning in South Robertson. The air is fresh, the sky is blue, and it’s quiet. It’s a perfect Spring morning. . . that is until the Clean Car Wash Campaign picket line just arrived to shatter the peace of the entire neighborhood. With their shouts of BOYCOTT! and ROBERTSON CAR WASH, YOU’RE NO GOOD! and BOOOOOO!!!!! their YELLING IS HEARD up, down and sideways, for hundreds of feet in all directions, entering the homes of residents.

Want to have a peaceful breakfast on a Sunday morning or maybe sleep in? Forget it if you live here. Just about every Sunday for 6 months these people – with their full knowledge of how disturbing they are to the residents – continue to SHOUT AND YELL with impunity. They play cat and mouse with the Los Angeles Police. When the police respond to a resident’s report, they lower their voices; but as soon as the police leave, they go at it again, as loud or louder than ever.

We are entering the 7th month of ANNOYING NOISE from union pickets. In March, Henry Huerta, Director of the Clean Car Wash Campaign mailed letters to all the residents saying he was sorry for the noise and they’ll do better. Mr. Huerta, if you are reading this, get your picket line to LOWER THEIR VOICES!

Their loud, mean, nasty and disrespectful behavior in this neighborhood has made us HATE YOUR CAUSE. We couldn’t care less about what it is you think you are doing because in reality, we KNOW what you are doing. You are disturbing the peace of homeowners and residents; and trying to force a family-owned business (who pays his workers in accordance with the law) out of business. Your campaign appears to be no better than an extortion racket, hiding behind the first amendment.
